Please find below Agility’s disclosure to the stock Exchange today;

Case Subject: Appeal from the order dated 6 July 2018 in the court of common pleas of Cumberland County Civil Division denying the defamation lawsuit filed by Kuwait & Gulf Link Transport Company, KGL Logistics and KGL Transportation Company KSCC.

The Superior Court of Pennsylvania upheld the ruling of the court of common pleas denying the defamation lawsuit against Agility, concluding that the letters sent by Agility to various U.S. government agencies dealt with matters of public concern and contained protected political speech, as well as information about KGL’s relationship with Iranian entities that was generally not in dispute and which KGL did not refute with evidence and proofs.

While the decision has no immediate financial impact, Agility is currently considering various claims for damages to be filed in the United States against third parties as a result of tortious behavior uncovered in the course of the proceedings.  The claimed amount is expected to be in excess of KD 30 million.
